X.Service of notices
(I)Valid Address. The contact number, email address, and contact address you fillin your BefuBefa user account are deemed as your valid notice address. If the above information changes, you should update it in a timely manner. If the contact information you provide is inaccurate or you fail to inform the changed contact information in a timely manner, so that the relevant notice (including but not limited to agreement changes, legal documents, etc.) cannot be delivered or is not delivered in time, you shall bear the possible legal consequences.
(II)Service of notices. BefuBefa sends you notices through the above contact information,in which the written notices sent by electronic means, including but not limited to platform announcements, mobile phone text messages sent to the contact number you provide, emails sent to the email address you provide,system messages and in-site messages sent to your BefuBefa user account, are deemed to be served upon successful delivery. Written notices issued in paper form shall be deemed to have been served on the fifth natural day after they are deposited in the mail at the contact address provided.
(III)Service of legal documents. For any disputes related to BefuBefa, you agree that the administrative, public security, judicial and other authorized authorities ma yserve you legal documents through mobile phone text messages, emails, system messages or internal messages, and the competent authorities shall be deemed to have served the legal documents by sending them to the above contact information; if the above multiple methods are used to serve you legal documents at the same time, the time of service shall be based on the earliest delivery. You agree that the above delivery methods apply to the entire process of administrative, arbitration, judicial and other legal procedures.
XI.Force majeure or other exemptions
(I)You understand and agree that in the process of using this service, you may encounter force majeure and other risk factors, which may cause the service under this service agreement to be interrupted or terminated. Force majeure refers to objective events that cannot be foreseen, overcome or avoided and have a significant impact on one or both parties, including but not limited to information network equipment maintenance, information network connection failure, computer, failure of computers or communications or other systems, power failure, strike, labor dispute, riot, insurrections, disturbances, insufficient productivity or means of production, fire, flood, storm, explosion, war, government behavior, changes in laws and regulations, orders of judicial and administrative agencies, other force majeure or inaction of third parties that cause failure to provide services or delays in services. In the event of the above situation, BefuBefa will strive to cooperate with relevant departments as soon as possible to make repairs in a timely manner, but BefuBefa will be exempted from liability for losses caused to you within the scope permitted by law.
(II)You understand and agree that, to the extent permitted by law, BefuBefa shall not beliable for any interruption or termination of service caused by the following reasons:
1.Damage by computer viruses, Trojans orother malicious programs, or hacker attacks;
2.Failure of the user's or BefuBefa's computer software, system, hardware, and communication lines;
3.Improper user operation;
4. User'suse of the service in a manner not authorized by BefuBefa.com;
5.Other circumstances beyond the control of BefuBefa or reasonably foreseeable.
XII.Applicable Laws and Others
(I)The conclusion, execution, interpretation and dispute resolution of this Agreement shall be subject to Chinese law. If any dispute arises between the two parties regarding the content of this Agreement or its execution, the two parties shall try their best to resolve it through friendly negotiation; if the negotiation fails, both parties may file a lawsuit with the People's Court with jurisdiction over the place where the Agreement is signed.
(II) Ifany clause in this Agreement is deemed to be repealed, invalid or unenforceablefor any reason, the clause shall be deemed to be separable and shall not affectthe validity and enforceability of any other clauses.
(III)Other rights not expressly authorized in this Agreement are still reserved byBefuBefa.com, and you must obtain BefuBefa.com's written permission when exercising theserights. If BefuBefa.com does not exercise any of the aforementioned rights, it doesnot constitute a waiver of such rights.
